International Law experts call Kashmir “Test Case” for UN credibility

MIRPUR (AJK) , (UrduPoint / Pakistan Point news - 17th Mar, 2026) The international legal experts have described Kashmir as a “test case” for the credibility of the United Nations, warning that decades of inaction risk undermining the global body’s authority to enforce international law.

The remarks came at a seminar on Kashmir and the right to self-determination held in Geneva, where jurists and scholars called for urgent international intervention to address “systemic failure” by the UN to implement its own resolutions on the disputed region.

The event, chaired by Altaf Hussain Wani of the World Muslim Congress, brought together academics and analysts.

The speakers included Amelie d’Hasusen, Robert Fitina, Ronald Barnes, Dr. Sajjad Latief, and Naila Altaf Kani.

The panelists reviewed a series of UN Security Council resolutions adopted between 1948 and 1971, including UN Security Council Resolution 47, which called for a plebiscite in Kashmir — a provision that remained unimplemented.

In his opening remarks, Wani said the principle of self-determination remained firmly embedded in international law but was hindered by political realities. “The legal framework exists, but enforcement depends on state power,” he said.

The participants also pointed to India’s 2019 revocation of Article 370 Indian Constitution, arguing it represented a broader challenge to the international legal framework governing the dispute.

The scholars at the seminar discussed the applicability of international humanitarian law, including the Fourth Geneva Convention, as well as the concept of self-determination as a universal legal obligation.
