ISLAMABAD, (UrduPoint / Pakistan Point News - 21st Feb, 2026) The Islamabad High Court (IHC) on Saturday ruled, during hearing of accused bail in attempted murder case, that once the trigger of the pistol is pressed and the target is hit, the intention of the accused becomes clear.
The accused cannot make his poor marksmanship the basis for concession for bail.
The Islamabad High Court ruled that considering the available evidence and the seriousness of the crime, the accused is not entitled to concession of bail.
Justice Khadim Hussain Soomro dismissed the post-arrest bail application of the accused Fawad Alias Mani in the attempted murder case. The accused is accused of shooting at the plaintiff's wife and son and injuring them.
In the written verdict, the court said that according to the record, the son of the plaintiff Shabana was hit by three bullets during the incident.
During the investigation, the pistol used in the incident was also recovered from the possession of the accused. It is a natural process to first shift the injured to the hospital. A delay of a few hours does not make any difference in the case.
In the written verdict, the court said that Section 324 PPC does not distinguish between a sensitive or non-sensitive part of the body. The direction of the bullet is not in the control of the attacker.
According to the police file, four other cases have been registered against the accused Fawad Alias Mani. The court said that the material on the record is sufficient to connect the accused with the crime. He is not entitled to bail.
The court ruled that the judicial observations are temporary in nature and the trial court should not be influenced by it while deciding on the merits.
